amybday Posted May 10, 2013 Report Posted May 10, 2013 Hi All, I am currently on H1B and I resigned my job as of 1st May since I want to be on H4 for some time to take care of my baby. I am traveling to India in a week and I am going to get H4 stamp at Consulate. My question is - do my employer need to terminate my H1B before I go for H4 stamping at consulate? I am not sure if my employer has already terminated/planning to terminate my H1B. Also, do I need to carry any letter from my employer? (like termination letter) Appreciate your help, Thanks!

kumar.kv Posted May 11, 2013 Report Posted May 11, 2013 I can answer only one of your question. If your employer has revoked your petition, the case status on USCIS website should be "Post Decision Activity" with a comment like this: On <this date>, previous decision made on your case was revoked and we mailed you a notice explaining the decision. If you have not received the notice within 14 days of the date above, please call customer service at 1-800-375-5283 for further assistance. If you move, please use our Change of Address online tool to update your case with your new address
deepaagrawal Posted May 11, 2013 Report Posted May 11, 2013 Hi All, I am getting married on dec 2013 and planing to apply for F2 visa(which would need Court Marriage ) as my husband is studying in US and having F1 visa and i need to go to US .. But as i am working in india and got my name in H1B lottery yesterday .. My question are: should i proceed and apply for F2 Visa, will it affect my H1B visa stamping? will my court marraige(legally married certifictae ) will affect my H1B visa processing. Since i have already filed my H1b visa petition as single status. how long will it take my F2 visa to process? should i wait for H1B visa stamping , so that if it would get approved, then there is no need to apply for F2 visa? What other problems will I face during my H1B/F2? your response will higly be appriciated.. Thanks in advance..
t75 Posted May 11, 2013 Report Posted May 11, 2013 You really need to read the USCIS website to learn your rights and RESPONSIBILITIES when an H1B worker.
