Green Card Perm Approval question

Recommended Posts

Experts,

I'm working as a consultant into an Indian Consultancy since last 4 years~.

Currently I'm into 3rd year of my H1b visa.

My employer applied for GC perm processing on Nov 2011, we got audit and eventually after 6-7 months (approx Junish 2012) my application was denied saying that my employer has posted both EB3 & EB2 quota job posting into one "SINGLE" Ad.

He re-applied for me in Oc 2012, this time employer gave two different Ad into newspaper one for EB2 & and another for EB3, I'm into EB2 as I did my masters from USA.

Till today (it is been 8 months) my application is still under Progress.

My questions:-

How long does it take to get approval for PERM processing (1st Stage)?

When I'll be elibigle for 7th year of H1b extension, is it after PERM processing approval or after I-140 approval?

It is true we can choose our own GC application Processing Centers, I heard from few of my colleagues saying that your employer has "Intentionally" kept into Slow Processing Centers?

Much appreciate your responses.

Thank You

Regards,

Kumar

Typically it takes 3-4 months. Mine was applied on Oct 18th 2012 and it got approved on Jan 20th 2013. My guess is your case is in audit phase again.

If your PERM is under review for 1yr or Approved PERM with I-140 under review for 1yr...you are eligible for 7th yr extension. Typically after i-140 approval you're eligible for 3yr H1B extension.

Ther is no such thing as slow processing centers. Ignore what your so called friends are saying

Your employer's attorney is not going to risk his reputation on something stupid. However, given the original mistake, I wonder if your employer is trying to do thing "in house" or on the cheap and not use an immigration law firm specializing in these types of filings.
