sh_2103 Posted May 9, 2013 Report Posted May 9, 2013 Company A filed my I-140 and its has been more than 8 months I-140 got approved. Now I am changing to Company B which will take atleast 6 months to start labor and I140 processing. If in between Company A revokes my I-140 ,could I be able to keep the priority date from previous company. what are my options to keep previous priority date. Any advice really appreciated
pontevecchio Posted May 10, 2013 Report Posted May 10, 2013 ordinarily you could. You do need some sort of proof of the approved I-140.
chikkubhai Posted July 14, 2013 Report Posted July 14, 2013 Same here, I have my 140 approved and want to know how the priority date retention happens when the new employer files labor and 140 within a year or so? i.e., how different is this process?
