Can i apply for F1 after H1 status negative

Hi,

I attended H1 interview at chennai in november 2012 followed by administrative query and it leads to negative result. Can i apply for F1 now?? Do they have my prior information regarding my H1B with them??

if yes, what would be my chances of getting visa F1.

Of course they have your visa application history.

No one can predict with certainty your chance of receiving an F-1 visa. F-1 is not for finding a job or working; it is for studying.

How do you defend yourself that you won't find a job after landing in US, because you have already applied for H1 before.

moreover, the denial of the H1b suggests possible fraud and an obvious desire to work in the US...so when the VO asks about your plans after completion of your 'studies', what are you going to answer that resembles the truth? I sincerely doubt you will be getting an F1 visa.

Generally, all F1 applicant(s) has to establish strong ties to the home country to overcome the presumption of immigrant intent under Sec 214(b) of Immigration and Nationality Act.
