prad31 Posted May 8, 2013 Report Posted May 8, 2013 Hello , I have an Valid H1B that expires in Oct 2014 but noticed that my LCA that was filed to support the H1 expired on Dec 31 2012. I have not changed my employer and I have not changed my work location (Continuing to work with the same client location) The only thing that was changed is my salaray, the salary was changed to match my PERM application Now my question is Should I go head and renew my LCA based on the current salaray? Also should we have an valid LCA all time or is it just to support during the Filing of H1B?
sk.january Posted May 8, 2013 Report Posted May 8, 2013 You employer should file another LCA so you are covered, you need a valid LCA at all times that matches your H1 petition(job profile, location, minimum wage etc) Salary increment might not be much of a concern to amend a H1 petition, but position or location changes need amend in H1 petitions.
