NJTransfer Posted May 6, 2013 Report Posted May 6, 2013 I recently got a NOIR on my previously approved H1B - I've consulted a lawyer etc. My question is - does anybody know what the impact of an H1B revocation is on the green card process ? If I change employers and file a new GC petition, can I carry over the priority date ? Thanks
cap-gap Posted May 6, 2013 Report Posted May 6, 2013 looks like these NOIR on approved H1Bs are all over the places recently.. more details are needed to assess your partucular situation..but in short you may have been in violation of status and it's not good to file 485 until you get a new H1 stamp..
JoeF Posted May 6, 2013 Report Posted May 6, 2013 It would depend what the reason for the NOIR was. Fraud-related things of course can have an impact. The PD for a GC can only be reused if the previous I-140 was approved.
