viddu512 Posted May 6, 2013 Report Posted May 6, 2013 Hello Readers - I currently pay State Unemployment taxes i.e. SUI/SDI tax in NJ State. Can anyone please confirm if this tax applies to H1B Visa holders? If it does, then are H1B Visa holders eligible for those benefits? Thank you.
omshiv Posted May 6, 2013 Report Posted May 6, 2013 once you are unemployed on H1B you are out of status.
pontevecchio Posted May 6, 2013 Report Posted May 6, 2013 Let me rephrase the eloquent advice given above. Unemployment benefits are available only if one has no work restrictions and can accept any job without restriction. On H1 no such benefits.

You have to pay these fees (they are not taxes, they go to an insurance, the state just collects the money.) But on H1, you are not eligible to collect unemployment benefits. To be eligible for unemployment benefits, a person has to be willing and able to work in any job. The latter one is not possible on H1.
t75 Posted May 7, 2013 Report Posted May 7, 2013 NO. Depending on the state TN visa holder may be eligible
