ksimha95@gmail.com Posted May 6, 2013 Report Posted May 6, 2013 Hi, I got laid off from my client on April 2nd week. My pay stubs were run till that time. I have then been on unpaid leave with my employer, without pay stubs. Now, I have found a new job with a new employer who has agreed to transfer my H1B visa. Can this transfer application be filed without my last few weeks' pay stubs? Thanks, Simha
JoeF Posted May 6, 2013 Report Posted May 6, 2013 There is no "unpaid leave" on H1, unless you are out of the country. You have been out of status. It is unlikely that a transfer will be approved as COS.
omshiv Posted May 6, 2013 Report Posted May 6, 2013 Technically your H1b might get approved..but you'll have to leave USA for stamping.

If you file without latest paystubs, then what will be your current status without pay-stubs?? You need to get paid everymonth on H1. BTW, what is this unpaid leave??
