Timeline for a new 797 approval reg.

Hi guys,

I got my H1B stamped during 2010 from company A in India and it expired in 2012 without being used. I'm planning to switch to company B.

I found out that I can re-use the previous approval to get a new stamping as cap-exempt from company B through members of this forum.

Now, is there any time line as to when I should apply for the new 797 approval? Some say I should have done it before the H1B petition filing period ends i.e., sometime in April. The employer says they can do it as soon as I join them.

Please clear this confusion for me.

Given that you were already counted under the cap, you can apply anytime you have a job offer ready and employer is willing to file the petition.
