I went to USA in mid 2009 on L1 which i later changed to H1B in Dec 2010. My I797 was valid until Nov 30, 2013 but i came back to india in Feb 2013. My question/query here is that am i eligible for applying for fresh H1B (out of quota) since i already had H1B and came back to India OR i will have to follow regular H1B under the quota? Thanks for your replies.
