krishnanj Posted May 1, 2013 Report Posted May 1, 2013 Hi All, Im planning to travel India on August 2013 and i have to attend Visa since my previous visa has expired and also i changed my employer recently (6 months back). I came to US in 2011 on XYZ(Big company) on H1 B and trasfered to another big consulting company in US on 2012 Nov. Im on EC model(no layers). Me>Employer>Client My current client doesnt give letter however they respond to USCIS when there is an RFE. Can anyone answer below questions, 1. What are the chances of visa approval since employement history is good. 2. Is client letter mandatory at hyderabad 3.what is the probability for RFE 4. Will they directly deny/reject visa without any RFE My first H1 B stamping was done at Hyderabad, it was very cool, just 2 questions where is your client and who is your manager, i never worried or tensed that time sicne, my empoyer is big and they will fight back for any RFE. My current employer says, consulates in India are simply denying h1b visas, not sure how far their statements are true. If this is the case, none can travel India anytime until they get GC :) Thanks, Krishna NJ
venkatakt Posted May 1, 2013 Report Posted May 1, 2013 I would say go to canada for stamping. with out client letter there is high probability that you will get 221g. since you are confident that your client will answer USCIS queries if asked , you can get your visa in 2-3 wks . its taking for ever in india if you get 221g

Is client letter mandatory at hyderabad Client letter is mandatory in any consulate. What's the use in responding to the RFE, if you can avoid the RFE by getting the client letter. Remember, successful visa interview doesn't depend on company size.

How is the visa stamping situtaion in hyderabad currently ,i have got my h1 approved last november till Aug 2015 my labour got approved last june ,my previous visa stamping was done in hyderabad i can get the client letter from my company fro the visa interview also i was on bench for 3 months from Nov 2012 to Jan 2013 now i have pay 3 months stubs from Feb 2013 till now ,is it feasible to go for Visa stamping in Vancouver or Hyderabad please advice Please advice

If yes, did you get paid during that time??

On H1 u need to get paid every month if you are in US. Remember, by the end of the year your W2 salary should be equal to LCA salary. If this is less than you are out of status for few days during that period. By not getting paid on H1 = out of status.
