madhu54321 Posted May 1, 2013 Report Share Posted May 1, 2013 Hi, my H1 was valid from nov 2010 to feb 2013. I worked for 1 yr and then applied for change of status (COS) from H1 to H4. Now I want to change the status back to H1 with cap exempt as I have a job offer. My question is 1) can I apply for COS from H4 to H1 even though my validity expired and I have used only a year if that validity 2) will it be possible to apply COS for rest of the 2 yrs I havn't worked. pontevecchio Posted May 1, 2013 Report Share Posted May 1, 2013 Your new employer can apply. You cannot. You are entitled to a total of 5 years in H1 status with no period more than 3 years at a time. Link to comment

omshiv Posted May 1, 2013 Report Share Posted May 1, 2013 I believe you cannot do a H1 Transfer as your Visa is already expired...but you can surely apply for another H1 and you'll be Cap Exempt. Link to comment
