Hemant Posted April 30, 2013 Report Posted April 30, 2013 Last year I switched company A to company B. My VISA got changed from L1B to H1B. My H1B VISA is getting expired in September 30, 2013 and my employer has already filled my H1 Extension in Premium 1 month back. Last week he received 2nd RFE on my H1 extension he already responded to that and we are waiting for H1 extension approval. Problem is I have to go to India in 5 days for 3 weeks to attend one important function on May 8th, 2013 and will come back to US on 25th May 2013. Can I fill DS-160 against my current H1B visa which is getting expired in sept 2013. Would me and my wife will face any problem in H1B Visa interview and in Port of entry because of that. Please advise.

Hemant Posted May 1, 2013 Author Report Posted May 1, 2013 Currently I am in US and on my Passport currently L1B Visa is stamped which has already been exipred last year. My VISA got changed from L1B to H1B COS last year in October 2012. But my H1B is not yet stamped on my Passport.
pontevecchio Posted May 1, 2013 Report Posted May 1, 2013 You will need a stamped H1 visa to return. Please note the H1 petition is not called a visa.
