H1 to F1 & F1 to H1

Hello All,

I am working on H1 visa, this is my 2nd yr.

My first approval was only for 1yr and then it was renewed for another 3 yrs (till 2015).

So, on my second renewal I have already spent about 6 month and have 2-1/2 yrs remaining.

Right now, I am having issues with my employer & with the short time he gave me to move I have no choice but to go to a college (transfer to F1).

I was wondering if I come back to H1 after college, would I still get the remaining 2-1/2 yrs (from my current term) and would my H1 start from the same spot in the timeline where I left off

OR

would I lose the 2-1/2 yrs (from my current term) and next H1 term will only be the remaining/ last 2 yrs out of the total 6 yrs.

You are entitled to 6 years minus 1.5 years = 4.5 years approximately in H1 status with no single approval more than 3 years. One cannot willy nilly decide to get in to F1 status. It takes a lot of time and admissions are at specific times of the year.

What pontevecchio was trying to ask was:

What makes you think getting F1 is so easy that you can "go to a college". Getting in to a college/university is not a piece of cake especially not as a floater for a couple of months.

F1 visa is intended for Full Time students who intend to pursue a degree and not spend sometime while waiting for H1 to come through.

And not to mention getting Admission to a university is on merit basis per session, you cannot get admitted mid session, at your will.

You can not just "go to college" from one day to the next.

Applying at a college takes several months.

Or are you saying you want to sign up with a fake university??? Such a move would kill your career in the US.
