swahom Posted April 28, 2013 Report Posted April 28, 2013 Hi, I have a valid H1B visa and would like to visit India and come back. My LCA is from California but working at a client in Phoenix,AZ (I don't have a client letter). Does immigration check at phoenix POE create any problem? If I mention my phoenix address in CBP form (when I re-enter US), I am afraid if the officer will catch me. If I change my POE to SFO, does it, in any sense(of course risk might be lesser), help me? But I feel the risk is same at both the POEs. Does the immigration officer really have access to this kind of information unless he asks me to show LCA? I am Thinking twice about my trip now. Can anyone please advice the best solution. Thank you. regards sah

rohang Posted April 29, 2013 Report Posted April 29, 2013 @swahom : my friend you have a bigger problem, if you are working @ different location than where you H1./LCA was approved for. Forget about client letter its not very important, but working in different state without proper documentation, it seems ur employer is fraud. And regarding you POE, it doesnt matter, till you have complete itinerary till your work location.
sk.january Posted April 29, 2013 Report Posted April 29, 2013 If the position offered by your employer is still the same, the employer should update the LCA and there is not need to re-file another H1. There is not restriction on what POE you should be travelling through, so you should be fine. Just carry all required documentation.
wiweq Posted April 29, 2013 Report Posted April 29, 2013 As rohang suggested, your current work has no authorization. That makes you out of status. Change your fraud employer and report it to ICE. You fail to report, you are partner in crime.
