funguyin Posted April 26, 2013 Report Posted April 26, 2013 My LCA is posted as a Programmer Analyst, where as my role is more of a Project manager. So, requesting this change via new LCA posting, trigger the H1B amendment? If so, what are the chances of this getting rejected? if the amendment gets rejected, will the previous H1 still stays valid, or that also gets rejected and I need to pack my bags and go back to India?
wiweq Posted April 26, 2013 Report Posted April 26, 2013 These days USCIS expects an H1b amendment for each LCA change. H1b amendment is nothing but filing a new I129.
sk.january Posted April 30, 2013 Report Posted April 30, 2013 Usually if the position offered remains same it is required to do an LCA update only. But if the position offered changes then the employer needs to file a new petition. Whether to file an amend or change in previously approved employment, employer/you need to consult a good immigration attorney.
pritam34 Posted July 3, 2013 Report Posted July 3, 2013 For Role change - H1B: Amendments - is it correct that only primary applicant need to do visa re-stamping, dependent need not re-stamp her visa if they are in India and never traveled to US?
