priyankaprim2 Posted April 26, 2013 Report Share Posted April 26, 2013 My old employer filed for a part time H1-B in 2012 and I am in the process of H1-b transfer but as a full time. Does that effect my criteria for H1 -b approval. Also do i have to notify my new company about the part time H1 that was filed by my old company. Link to comment
Attorney_10 Posted May 2, 2013 Report Share Posted May 2, 2013 Generally, the terms of the H1B petition with Company A will not impact how Company B files a new petition on behalf of the same beneficiary as long as the beneficiary can demonstrate s/he has maintained valid H1B status at all times. If the beneficiary is requesting an extension of status with the change of employer petition, then Company B must include a copy of the beneficiary's I-94, I-797 approval notice, and recent paystubs from the H1B employer to demonstrate the beneficiary is maintaining valid H1B status at the time of filing.
