OPT denied

I have received my opt I765 denial notice on 15th June,2011 stating the reason as engagement in full time CPT of 12 months or more. But my actual duration of study in that university was only 4 months and transferred to another university and not applied CPT further . I am preparing to file a MTR I290B but I would like to know the grace period to maintain legal status after denial of I765 EAD. Also, I would like to know what will be my status during the process of MTR I290B.

If you worked full time for 12 months on CPT you are not eligible for OPT. OPT is granted only upon completion of study and a F1 student should apply for it at least 3 months before graduation. You will be eligible again if you change your study to a higher degree upon completion of that study and if you do not engage in full time employment for 12 month as a part of CPT.

Currently you are out of status and should leave the US unless you apply for COS. But need to do it ASAP.
