Wife pregnant on OPT extension

We just came to know that my wife is 1 month pregnant. She is working on her OPT extension right now and has just completed 2 months on it. Her company filed H1 for her but looks like her application did not get selected in the lottery.

My question is -- will she be able to go for 3 months of Maternity leave once the baby is born and continue to work on OPT extension once she completed 3 months? I am trying to find information about it. Not that it would make much difference. We both are very happy but would like to know of our options and be mentally prepared.

Normal time off for a delivery is 6 weeks - not 3 months. She needs to be prepared to return to work just like USCs would have to and not expect special; treatment. You two should be finding a babysitter.

It is possible to take a extended time off after pregnancy telling you need to take care of the baby. And since your wife is on OPT extension she shud be absolutely fine. No issues. Just submit the appropriate leave letters to the employer so that you have all the paoer work.

Maternity leave required by delivery is one thing a three month leave is something else.

Dude, I don't know why you are after 3 month statement. Just FYI , In her company maternity leave is for 12 weeks (3 months) which is why I mentioned in my earlier statement. I am here to gain information on the situation we are in. I don't see a reason to be rude here.

Ignore t75's comments, it is his/her nature to be negative all the time. Maternity leave duration is generally 6 weeks but then depending on state you can get extra time off like in CA. So your wife can very well get 12 weeks off, ask her to talk to the company HR and if she is a full time employee on OPT she should be eligible for the leave.
