Associate Degreee - H1B Eligibility

Hi

My wife is currently on H4 and pursuing Associate Degree in Business Administration. She has B.E(Electrical and Intrumentaiton) and MBA(Marketting) from India . This associate degree is 2 year course and she does not have any work experience other than 6 months of internship back in India.

We wanted to know if she is eligible for a H1-B and would she fall under 65000(Regular) quota or Advanced Degree(20000) quota of H1B.. ?

Your responses would be of great help.

No, because by definition, a job that falls into this category must be a 'specialty occupation requiring a bachelor's degree and/or the equivalent in related work experience...'...which would mean she needs about 2 years of related experience to make up for the missing two years of education.

Associates is below BE degree. Why would she have ever taken that course when she has an MBA? She certainly would NOT qualify for advanced degree quota as she should have NEVER been allowed to enroll for credit in associates classes. An associates degree does NOT qualify for an H-1B at all. That was a really poor choice.

For an H1, the person would have to have a degree equivalent to a 4-year US Bachelor degree.

An associate degree is a 2-year degree and can not be used for an H1.

I'm wondering why the OP cannot file H-1? Does the applicant not already have a bachelor's degree? or must the bachelor's degree be the latest education?

That's correct. She already has 4 yrs of Bachelor's degree that means she is eligible for H1 if she finds a job related to her degree and falls in specialty occupation.

OP wake up and let us know whether we are correct or not?

OP wanted to use additional 2 year degree for masters quota.

I don't see anywhere OP mentioning about master's quota. He was asking whether his wife is eligible for H1 or not.

Anyway, now its clear that she can apply for H1 next year in regular quota.

Please re-read the OP's post. He asked if she would fall under the normal or the advanced degree quota.
