My first H1B visa initiated on 2006 and I was in US on H1B from 2007 - 2010 (A & B company) i.e. 2007 - 2008 - A Company 2008 - 2010 - B Company (Transfered H1 B Visa and valid till Jan 2012) For 6 Years H1B Visa I was in US for around 3 years. On Dec 2010 I went back to India and joined C company and got H1b transfer before my previous visa expired. Then again I came to USA on May 2012 (It mean moved back to India and stayed out of US for more than 1 year) My question is 1. Will my H1b clock get reset ? 2. Am I eligible to stay 6 years starting from May 2012 ? Awaiting for response. Thanks, Sri Link to comment
shekar11# Posted April 22, 2013 Report Share Posted April 22, 2013 1. Will my H1b clock get reset ? NO. Becoz you have to stay out of country for 1 year and then apply in normal procedure under cap i.e. which starts on April 1st and wait till October 1st if you get ur H1 approved. Link to comment

And that's why your time is NOT reset. To reset the time, you have to be abroad for over one year, and THEN get a new H1 under the cap. By doing just a transfer, your time abroad became useless.
