TDAY2006 Posted April 19, 2013 Report Posted April 19, 2013 Hi - I'm nearing the end of my initial 6 yr H1B. My I-140 and 3-yr H1B extension (beyond initial 6 yrs) are approved with current company. I'm getting married and moving to a new US city which means I'll need a new job. Assuming I find a job, I request 3 answers: 1- What does the new employer need to do for me? Both for (a). H1B and (b). Permanent Residency. 2- For (a). Will the H1B extension carry over to new employer by filing for some change of status? 3- For (b). What portion(s) of my completed Green Card process can I carry-over to new employer? If nothing, does that imply I'll have start all over again with PERM with new employer? Thanks in advance T Day
pontevecchio Posted April 19, 2013 Report Posted April 19, 2013 1. He can hire you in H1 status and also sponsor your GC. 2. The new employer needs to file and get a H1 petition approved for you 3. You retain the PD of the previous application though the process starts from scratch.
blancx Posted April 19, 2013 Report Posted April 19, 2013 1 - File H1 and GC applications. 2 - You can get any remaining portion of the 3 yrs extension with the new employer. 3 - start GC all over again with new employer, but you may be able to retain priority date.

If his previous employer revokes his existing I140, can he use previous PD?
