H4 extention when out of country

Last week we sent documents to attorney for H4 extention of my wife,today she traveled out of country for emergency reason , she will be back in a month, and has valid visa until sep2013

q.,do I have to inform the attorney ?

H4 petition has not been filled yet. can H4 petition can filled for extention when out of country ?

As has been said H4 is a status. Nothing called a H1 petition as such.

Ask your attorney to not file the H4 extension (I-539). You can do that once she is back in the country, before H4 visa expires.

There is no point applying for an extension of stay when she already left the country.
