Got extension of visa in June 2012 while we(myself and wife) were in US. We went to india in Jan 2013 and got the visa stamping done(Valid till Dec 2015). I cam to US alone and changed the job in March 2013, now I work for company B. My wife has to come to US, Can she travel on old company H4? or do i need to file a new H4 through my employer B. pontevecchio Posted April 18, 2013 Report Share Posted April 18, 2013 H4 has NO CONNECTION to the employer. Her H4 status is ONLY based on your valid H1 status. All she needs is a H4 visa and your latest H1 petition approval for the company you are working for. Link to comment

The approved petition for B is on record. 3. She can bring the original or your copy of the H1 petition approval. Link to comment

If your cap exempt H1B petition with employer B is approved then your wife needs to show at POE her unexpired H4 visa and copy of employer B's I797. Link to comment

I can only file for h4 extension once I join the new employer. What happens to my wife's status, until the time of preparing documents and filing for an extension with USCIS. Please help If you are no longer working for old employer then your wife cannot travel using your old I797. She needs to wait for your new employer's I797 and then travel with a copy of it and a valid H4 visa. Link to comment

My dependents have never traveled to US before yet they have old employer name in the visa while I've transferred my visa to another employer. I can provide all valid I797, my I94 and paystubs etc valid till Aug 2016. Let me know if its safe. Link to comment

But in my case the my wife has a valid H4 visa stamped from my ex employer and i changed the employer without getting the approval notice(joined just on receipt). Now she is looking to travel to USA. Will they allow with previous emplyers H4 visa stamped and new company's transfer receipt? Please help me with this Link to comment

I recently changed from Company A to Company B on H1-B. My Wife currently holds a valid H4 VISA stamped through my previous Employer A. My H1-B transfer is still in progress through normal processing. Can she travel with just the receipt copy OR she needs my approved 797 from employer B? Kindly advice Link to comment
JoeF Posted December 20, 2016 Report Share Posted December 20, 2016 An H4 is never dependent on some employer. It is not "stamped through an employer." The H4 requires that you are in valid H1 status. That's it. It has always been this way, and nothing has changed. Why do you think it did change? Link to comment
