Thankgod Posted April 18, 2013 Report Posted April 18, 2013 Hi I am going for visa stamping in chennai consulate. My H1-B visa expired in dec 2011. I got an extn till jun 2014. One of the criteria for drop box is to say yes to this question ."If I am applying for an H or L (individual) visa, my prior visa in the same classification with the same petitioner is still valid or expired within the last 12 months" I have been with the same employer since 2007 and have got the stamping twice when i previously went to chennai. What should i ans to this question. should it be yes or no. Its very confusing.
Attorney_11 Posted April 18, 2013 Report Posted April 18, 2013 In most cases, the answer to this question depends on the last validity of the visa stamp in the passport, and not the status in the United States. It may be helpful to clarify with a qualified immigration attorney during a consult, to answer the question with respect to personal circumstances/situations.
shekar11# Posted April 19, 2013 Report Posted April 19, 2013 You should answer NO to this question. It clearly says about your visa stamp. If it is valid or expired in last 12 months only then you can use drop box option. Since your last visa stamping expired in December 2011, the latest you could have used drop box option is December 2012. Now you have to attend the interview.
