prawah Posted April 16, 2013 Report Posted April 16, 2013 I would like to know that what type of questions to expect in case of hourly salary (listed on LCA) and what are the issues with it. Can i say a fixed amount instead , when VO asks me about my pay. I have fixed amount listed on my employer letter and on calculating the hourly pay for 40 hour/week its comes out to be the same (yearly) Although my pay stubs does not shows the hours i worked, just says monthly. Inputs appreciated.

So you suggest that i should say my hourly salary when VO asks me about my pay ? I am not lying here, i get paid $xxxxx yearly when calculated (hourly rate*40 hours*52 weeks) and that's what listed on my W2 and employer letter.

Dude, I don't have any problem with the truth. You need to suggest me what should i do in this case. My LCA has hourly salary. W2 has less salary (annual) than that listed on employer letter but is higher that that of LCA (when calculated for an year). I haven't even completed first year of H1B, so technically the LCA amount starts from the moment i get my H1B. which monthly amount should i use in DS160. which one should i say, one on W2, one on LCA

You may need to explain all the details to the officer. But you can NOT hide things, or lie about things. Explain the whole situation, don't leave things out, don't hide things, just the truth, the whole truth and nothing but the truth.

THAT simple You know that you will have to carry your pay-stubs (atleast last 3-4) with you for stamping. if you didnt get same salary each month since you are on H1b, write -> (total of all your pay stubs from current employer)/number of months since you are employed.

prawah Posted April 19, 2013 Author Report Posted April 19, 2013 @Bids23 LCA is the minimum amount so it really dosent matters, you should not be paid less than LCA amount during your H1 period, dont count OPT period in it (You might get less pay during that period---in my case) So the current salary is the solution (I am going to write that on my ds160), what every I am earning currently should be the answer and you can always give explanation that the pay has been increased since then (when you LCA was filed) since this is the truth in my case. 1. If Actual Pay>LCA PAY (for H1 period)--This is no problem 2. Should be. W2>= LCA amount (whole year-only H1) in my case i was paid less during OPT period and H1 just started last year. So I need say that to VO that I was on lower pay rate during my OPT (pay for 6months on H1 multiplied by 2= yearly salary) Also @JoeF i dont have my one pay stub from my OPT period, is there any issue with it ? please comment if above is correct

You can check with your payroll system, for e.g. ADP etc, not sure which one your employer was using. They generally have historical records.
