Valid H1 to H4 and then to H1 - cap exempt ?

Hi,

My wife has a valid H1B visa and Since she dint get any projects from her current employer she is now resigning the job and coming under H4 to US . If her employer cancels both her H1 visa & petition while resigning please let us know if its possible to initiate H4 to H1 transfer in this year 2013 under the exemption ?
