guru18 Posted April 9, 2013 Report Posted April 9, 2013 Hi I am working for indian MNC and my visa & i-94 expired in last Dec'2012. My employer filed for non-premium extension in last June'12, but there was no response on the same either from USCIS or my employer. Then after escalation within my organisation, travel desk in my company applied premium extension in Jan'13. I was told that the existing non-premium case was converted to premium case. I have got mail from my employer saying that my visa is approved :-), but for consular processing and consular notified at chennai :-(. Also I am intimated that payroll processing has been stopped. I would travel to chennai to get stamping, but my spouse is pregnant and 36th week running now. Due date is 10th May. Kindly let me know the possibility of staying in USA in any status legally for delivery and I would be able to travel after delivery. Any possibility to travel nearby countries for stamping? Please let me know options as i am not in the situation to travel for atleast 45 days due to complexity in pregnancy... thanks in advance...

designflaw Posted April 16, 2013 Report Posted April 16, 2013 I guess I am confused. If your work visa expired 12/2012, that means u have not been working since then. Under what status are you in USA since 12/2012? Either way, I think the best course of action is to consult a lawyer to see what options you have.
