becheers Posted April 3, 2013 Report Posted April 3, 2013 Here's my situation: I have H1B petition approved and it is valid from Jan 11, 2013 till Jan 10,2014.My employer says currently there is no opportunity for me in US. So please clarify my below questions: 1. Once my petition expires in Jan 2014, is there any chance I can extend it or should I again file a new petition under the same CAP and undergo all the process (like lottery system, verification etc) 2. To extend my petition or to file a new petition under same CAP, should I have been travelled to US atleast once? 3. What if I get H1-B stamping but dont' travel to US before Jan 2014? In this case, can Iextend my Visa period in India? 4. If I can extend my Visa in India, could you please tell me in detail the extension process? Thanks in advance!
omshiv Posted April 3, 2013 Report Posted April 3, 2013 have you considered the option of finding another employer? you need not wait until the end of this expiry.

Also, after Dec 2013 if I switch over then my company says they will cancel my petition because it is non-transferable. I really don't know the process/laws behind processing US visas. Would appreciate your effort in clearing out my doubts.
