Late H1B Amendment - Please Help!!!

Hi Forum Experts,

I have couple of critical questions please answer -

1. I have a approved H1B for period of 10/01/2010 to 10/01/2013 with my employer at In-house project, but I got a project in some other company in December 2010 in different state, Since then I've been with same client.

Question is I recently applied for amendment of my H1B in premium process with this client, which I working since Dec. 2010, I don't what the result will be for amendment.

If VO asks below questions .....what should I answer???

1. where do you work?

2. How long you are working with your company?

3. how long you are working with client?

4. how long your project with the client?

5. why did you amended so late?

6. why didn't you amended early?

Please answer ......

Avoid going for stamping. Wait until this petition expires and the new one is applied for an extension.

If you go for stamping now, you'll get visa for 6 months only and you'll again have to for visa stamping. Hence avoid stamping would be my suggestion.

Other than that if you were asked above mentioned questions, just tell the truth. I don't know about what you can answer 5. and 6.

As you understand, the amendment must have been done before you started working in 2010 at the new client site. Not much you can do except to say the company realized the mistake and have corrected it.

Don't think the VO will ask Qs 5 & 6.

For rest of the Qs answer the Truth.

Its better if you file for H1 extension and go for visa stamping, instead of going for stamping with H1 Amend.

Kindly avoid stamping now and go for stamping after extension.

Unless it's urgent, as lostpacket replied above I would wait. Infact you can initiate your H1 renewal and just do premium if you wanna do the stamping soon.
