What wil happen if my H1B gets denied after response to RFE....stilll can i stay in US since I have my I-140 approved??? Thanks in Advance.

Belle Posted April 1, 2013 Report Posted April 1, 2013 Fitst, your H1 is not denied yet. Don't make it look like a done deal. Second, if your H1 extention is denied, you can work on whatever is remaining on your current H1. Then, you can either file another extention or leave the country, assuming you don't have a pending I-485, which is impossible to tell from your question.

I don't have pending I-485, just got my I-140 approved and PD in OCT2011. What will happen to the approved I-140 if I leave the country if the H1B Extension gets denied?
