Tech_Rec Posted March 28, 2013 Report Posted March 28, 2013 Hello, I have a question about my maternity leave. About my background: I am currently employed as a full time employee in a small IT consulting firm role recruiter position. We have approximately 75 - 80 consultants working and spread accross US. I have been working in this company for the last 1.3 years and have received one page appointment letter stating no benefits provided.Location: HO in St Louis, MO and IL Incorporation. I would like to know : 1.0 Am I eligible for Maternity leave. 2.0 If yes, how many weeks of paid leave 3.0 How many weeks of unpaid leave I am eligible to take. 4.0 How many weeks of maternity leave in general you get. Thank you.
JoeF Posted March 28, 2013 Report Posted March 28, 2013 Why would you work in a company that provides no benefits? Do you have other health insurance? Do you know how much delivery costs? Maternity leave stuff is governed by labor law. There is some leave specified in federal law, but it isn't all that much. And it would depend on the number of employees. Just search the Internet. There is lots of information on the Net. You may start here: https://en.wikipedia.org/wiki/Parental_leave#Americas
wiweq Posted March 28, 2013 Report Posted March 28, 2013 How is your post related to H1b? Are you a recruiter on H1b?
t75 Posted March 29, 2013 Report Posted March 29, 2013 How can you be a corporate recruiter when you have no idea about the benefits offered. Standard maternity leave is 6 or 8 weeks depending on delivery. Paid leave is company dependent and is a benefit; if you have no benefits you likely do not have paid leave. Depending on the actual structure, you may be eligible for FMLA. You need to talk to your HR people. I sure hope you have health insurance through your husband or you are going to be in for a nasty surprise about the cost of delivery.
Tech_Rec Posted March 29, 2013 Author Report Posted March 29, 2013 Thank you everyone for your reply. Just to add further information: We are only 3 people working in the office. There is no HR policy or HR personnel. Everything is managed and run by the owner of the company. We don't have any benefits provided by the company. I have no manual / policy to refer to. Also, I am a GC Holder ( This is my first time post here. Apologies for entering in this discussion. Was unsure about the forum to put this information). Kindly help me in understand how many weeks of leave I am entitled to take or what is the general trend for such a small company where there is no benefits , no HR policy's etc. Thank you once again.
Tech_Rec Posted April 1, 2013 Author Report Posted April 1, 2013 Hello, Just curious to know that would it be difficult to determine how many weeks of Paid or Unpaid Leave I will be eligible to get in my scenario? I need to have some idea before I start conversation with my employer. Thank you in advance for all your help and response.
JoeF Posted April 2, 2013 Report Posted April 2, 2013 You haven't answered some of our questions: Do you have health insurance? Do you know how much delivery costs? If you don't have health insurance, do you have $16K-$20K to pay for delivery???
omshiv Posted April 2, 2013 Report Posted April 2, 2013 your employer is taking undue advantage of you...forget about paid leave and other stuff...im hoping you are aware of health insurance..and hopefully you have one. if there's no HR policy and its a mom n pop company..you are like your own boss..and can take leave and come back whenever your employer wishes.
