Now with the USCIS saying that they're expecting the quota to get met and they'll do a lottery i was thinking of a backup. And yes I've talked with my employer and they're on board with filing for green card. My STEM OPT ends May 2014 so i have time. Everyone in my position has a Master's Degree in Mechanical/Aerospace Engineering including me so the job would fit the EB-2 classification. Since I would be EB-2 ROW does that mean after PERM gets processed employer can file I-140 and then I can file I-485 and EAD/AP all at the same time? Thanks!
Belle Posted March 28, 2013 Report Posted March 28, 2013 You can file I-140, I-485, EAD, and AP concurrently. In fact, that should be preferred way to go about it, not the H1.
shandan Posted March 28, 2013 Report Posted March 28, 2013 Yes, since the EB2 ROW PD is current, if they infact file for GC in EB2 then you should be able to file them together.
