SAS1856 Posted March 20, 2013 Report Posted March 20, 2013 Hi, I got my previous H1 in mechanical engineering but, got laid off before my H1 got active, I transferred my H1 to a consultant company and got it approved with consular processing since, I didnt have paystubs on previous H1. I have my stamping on the 8th at Vancouver. Would there be any problem? Please help
ulovekris Posted March 20, 2013 Report Posted March 20, 2013 Need more details to answer your question. Clearly mention your H1B approval dates and your bench period. *If you got H1B approved with consular processing, you should not be staying any longer in USA, (as approvals with consular processing don't come with i-94) , should leave the country immediately , get stamping and come back to US. Please consult an qualified attorney before you go for stamping. I could see lot of risk involved in your case.
Attorney_25 Posted March 21, 2013 Report Posted March 21, 2013 Generally the US consulates in Canada will not accept a visa application if the applicant has a period out of status in the US.
