trivedi3377 Posted March 19, 2013 Report Posted March 19, 2013 Hi all, I was on H1b visa , got h1b extension and my petition (I-797) till may - 2014, came to India for visa stamping. VO gave me 221(g) query and finally received letter saying that we are sending case to USCIS for review. Today I received email from USCIS as below" "On March 19, 2013, we mailed you a notice indicating we intend to revoke the decision made on your case. That notice will explain in detail what action we intend to take. Please read it carefully when you receive it. If you have not received the notice within 14 days of the date above." My question is that as I have valid petition(i-797) till May -2014. Does that is going to be valid after this update also? Can I use that same I-797 to transfer h1b visa to another company(obviously I have to go to stamping again)? Regards, trivedi
Attorney_11 Posted March 20, 2013 Report Posted March 20, 2013 An individual outside the United States who is the beneficiary of an approved H-1B petition may seek to apply for an H-1B visa at a US consulate in order to be issued a visa to seek admission to the United States in H-1B status in order to work for the employer who filed the H-1B petition on behalf of the individual.

After getting Notice of intend to Revoke(NOIR), can I use same Petition (I-797) which is valid till May -2014, to do H1b transfer with another employer? Obviously new employer will file H1b transfer by using this I-797. Can I do that? Please response. Thanks, Trivedi
