JoeF Posted March 6, 2013 Report Share Posted March 6, 2013 You are not filing an H1 petition. A prospective employer can file an H1 petition for you. And it is not a visa. A visa is an entry document that you get from a consulate. If an H1 petition gets denied, you are in whatever status you were before. Link to comment
pontevecchio Posted March 6, 2013 Report Share Posted March 6, 2013 They are mutually exclusive. You can stay in H4 status even if the H1 is denied as long as your spouse is in valid H1 status. Link to comment
