maverickAlien Posted March 5, 2013 Report Posted March 5, 2013 Can any attorneys/guys please answer my query.. Thanks in Advance.. I have four months left on H1-B (six years going to be completed) and since my earlier perm(labour) was denied (due to minor issue), my lawyers are suggesting me to file another Labour. They are suggesting me to go for visitor visa and stay in US once my H1 expires till I get I-140. How easy/difficult is this to do? Can it be done and will there be any issues in the H1-extension (after I get I140). Thanks

Attorney_11 Posted March 20, 2013 Report Posted March 20, 2013 Generally, bridging a gap in status with a visitor or other classification in anticipation of becoming eligible for a work visa is disfavored. A personalized case strategy is likely required to navigate this matter. It is advisable to seek the counsel of a qualified immigration attorney.
