rock Posted March 5, 2013 Report Posted March 5, 2013 I am currently on AOS based on pending I-485 for 6 years. I have EAD and AP. My last entry to US was based on AP more than a year ago. My employer recently filed for my H1B extension beyond 6 years and got it approved until 2015. 1) What is my current status after getting the H1B petition approved? 2) Do I have to exit the country and come back to change the status? 3) Can I transfer H1B to another employer now?
Attorney_11 Posted March 6, 2013 Report Posted March 6, 2013 Current interim USCIS guidance considers individuals whose H-1B classification was interrupted because of an Advance Parole travel and have applied for and been approved for H-1B extension to be H-1B status holders. For additional clarification, please seek the counsel of a qualified immigration attorney.
Attorney_25 Posted March 6, 2013 Report Posted March 6, 2013 This assumes that your H-1B extension was filed before the expiration of your previous H-1B petition and was approved with an I-94.
