sandeep17 Posted March 5, 2013 Report Posted March 5, 2013 I have my I-140 approved recently and I am currently in my 7th year H1B. The H1-B expires Dec 2013. If I decide to switch employers now and when a H1-B transfer is done, Will I get a 3 year extension. I am asking because the I-140 is from Company A and the H1-B transfer is for Company B. Attorney_11 Posted March 8, 2013 Report Posted March 8, 2013 Generally, in individual who is the beneficiary of an approved I-140 in a backlogged category may seek or be eligible for an extension of 3 years beyond the end of the six year H-1B maximum limit, even if the I-140 was filed by an employer other than the employer seeking to file a petition requesting H-1B classification beyond the 6th year.
