pulze Posted March 5, 2013 Report Posted March 5, 2013 Hi all, My parents got Green Card in 2006 but have not been able to stay in the US as permanent residents. They visited a few times and answered all questions at the port of entry without problems. However, they want to give up the Green Card and apply for Tourist Visa, instead, due to personal problems. My questions are: 1) Can they ask for a tourist visa when they surrender their Green Card in the US consulate and get it? 2) Will they have to take a separate appointment to get tourist visa and pay extra for it in India? 3) How does this process generally work? Any help is much appreciated. Thanks in advance. Regards, /PS
Attorney_11 Posted March 5, 2013 Report Posted March 5, 2013 Abandonment of Lawful Permanent Resident status needs to be reviewed carefully. There is no prohibition from previous lawful permanent residents successfully applying for visitor visas if they are eligible. It would be advisable to seek the counsel of a qualified immigration attorney.
