Previous Employment details for H-1B

I am a mechanical engineer and currently working for a firm in FL. Before I joined the current company, I worked 2 months for a software company and they ran my payroll. I also got my W2 for that term. When I joined the current company, I din't disclose the previous employer info since it is not related to mechanical.

Now, I am filing my H-1B and I heard from different sources that If I go for stamping, they would ask all my W2's and tax info. In that case I would fall into trouble. I thought of telling my HR personnel about the previous employer, which could also get me into trouble. Since, I din't disclose the previous employer info at the time of hire, they might take it serious.

Can you please suggest me what I could do in this case.

You must not conceal relevant information from the consulate at a visa interview, as this could be viewed as fraud or misrepresentation causing you to be permanently barred from the US. That being said, if you've worked for your new employer for a while before you go to the consulate, they are unlikely to ask for proof of prior maintenance of status, other than confirming that you did in fact have some proper status during the time you were in the US.

My non-legal opinion is that an employer will understand that some prior employment wasn't disclosed because it wasn't relevant to your current position. If, on the other hand, you told some sort of affirmative lie, you may have trouble.

You may want to consult with a qualified immigration attorney on your immigration issues. That will not necessarily solve a problem with your employer.

I would not conceal any information during stamping. But, the main problem is with my current employer filing my H1B. I started working with my current employer on OPT STEM Extension. I did not lie but Since I worked for software consultancies, I dint disclose any of my employment information during the first year of OPT to my company.

-- Is it mandatory to provide all the OPT employment history for H1B filing?
