ram1023 Posted March 4, 2013 Report Posted March 4, 2013 Hi, I have applied for H1B from L1B through a consultant when i am in US. but my present company sent me back to India before H1B got approved. After I came back to India my H1B got approved. Currently my present company wants to send me to US on L1B, L1B is valid till Sep'13. So here my question are, 1. Can I come to US on L1B, will it be a problem at immigration while entering into US as my H1B got approved. 2. Once i came to US L1B, can i start working on H1B after resigning to my current company or do i need to go for stamping. Pls clarify me.. Thanks in Advance..!!!
Attorney_25 Posted March 4, 2013 Report Posted March 4, 2013 A person may travel on L-1 despite H-1B petition approval, if he is entering the US to take up the L-1 job. Once in the US L-1 status, a person generally needs a change of status filed or needs to leave the US and enter based on the H-1B petition. To discuss this issue further, you may want to consult with a qualified immigration attorney.
