My question is regarding the I-94 number that would go under Part 1 of the I-485 form: My I-94 (white card) on passport from last POE has an expiration date of 9/5/2012. It was stamped in Feb 2012. I have a I-797 approval notice for an extended H-1B with same employer from 9/6/2012 to 9/5/2015. The second visa is not yet stamped in my passport. I think I am not out of status as there was no time period in which I did not have a valid H-1B. My question is which I-94 number should I enter in the box 'I-94#' in part 1 of the I-485 form, i.e. from the white form on passport or from the latest I797? For the first three years of my H-1B I received an I-94 number and the visa was stamped. When my employer extended the H-1B, I received a different I-94 number. This visa has not been stamped on the passport. Will it create any problems if the I-94 numbers are different? Whatever the latest you got. Actually, the numbers should be the same. Link to comment
