ss1082 Posted March 2, 2013 Report Posted March 2, 2013 Hello, My H1 got approved in November 2011, and then I went for a visit to India. The embassy didn't stamp it and I got a 221g. After waiting for 6 months, my employer withdrew the petition, and I came back to US on an F1 visa. Here are a few questions I have: Can I still work for the same employer on the same visa? If not, can they apply for a fresh H1 visa for me? Is my previous H1 transferable to a new company? Can they do this while I am still in school? In case my H1 gets transferred while I am still studying, can I go ahead and finish my degree? Any advice on this will be appreciated. Thanks.
t75 Posted March 2, 2013 Report Posted March 2, 2013 You do not have a current petition. You cannot work on H1B unless and until you have an I-94 for H-1B.
