inkprs Posted February 28, 2013 Report Posted February 28, 2013 Dear Sir/Mam, I was in post Bachelor's degree F1/OPT status till October 2010. My H1B started in October 2010. I did change of status from H1B to F1 in May 2011. I am currently in post Master's degree F1/OPT status as my OPT started in October 2012 and is valid till October 2013. I want to go to H1B status now. 1. Can I file H1B right now? I mean in February 2013? Do I need to wait for the quota in April 2013? 2. Since I have already crossed 1 year 9 months since Change of Status from H1B to F1, don't I need to get into the lottery system in April 2013? Sincerely, Leo
t75 Posted February 28, 2013 Report Posted February 28, 2013 As long as you have time from the 6 years max of H1B, you may COS at any time for the remainder.
JoeF Posted February 28, 2013 Report Posted February 28, 2013 If you have been counted for the H1 quota in the last 6 years, you are not counted again, and an employer can file an H1 petition for you at any time.
Attorney_11 Posted February 28, 2013 Report Posted February 28, 2013 Generally, an individual who has previously been approved for H-1B status and has counted against the H-1B cap and has H-1B time remaining is not counted against the cap again for subsequent H-1B extensions or change of employer petitions.

ready2go Posted September 18, 2013 Report Posted September 18, 2013 inkprs, I am in a similar situation. How did you get your COS from F1/OPT back to H1? Is it as easy as doing COS from H1 to F1?
