GA12 Posted February 27, 2013 Report Posted February 27, 2013 Hello, I am working with company "A" on L1B visa since 2010. My L1 visa expires in June 2013 and my current I-94 is valid till 2015. This year my company is planning to file H1B application through normal processing in April. I need to travel to India for few days during first week of May 2013 which I can't avoid. I have some following questions: 1] Does it affect my current H1B processing if I travel on valid L1 visa when H1B is still in process? 2] Do I need to do "Change of Status" or some additional procedures after coming back to US for H1B approval? 3] When I come back to US in May, I'll have new I-94. Do I need start H1B processing again with new I-94? Please provide your expert advice on this. Thanks in advance.
t75 Posted February 28, 2013 Report Posted February 28, 2013 If you do not have the H-1B I-94 before you leave in May, you will have to file a COS or go for stamping. It may be worthwhile for you to ask (and pay ) for PP.
