I completed my 6 years on H1b in Sept/Oct 2012. I have a vaild H1B visa and work permit till Sept 2013. I recently found out that my employer has not filed for my green card and has asked me to travel back. I have stayed in us on H1B for 6 years and 7 months now. What are the repercussions of my over stay and what are the action I can? Venu
JoeF Posted February 27, 2013 Report Posted February 27, 2013 You have been working illegally for the last 7 months. This will result in lots of problems. You should discuss your situation with a good immigration lawyer ASAP.

I do have a valid I-94 and work permit That was issued in error and USCIS will eventually revoke that and make you illegal retroactively. You need to discuss your situation with a good immigration lawyer ASAP!
