gitz30 Posted February 27, 2013 Report Posted February 27, 2013 My H1B was issued in Sept, 2007 so the 6 years would be completing in Sept, 2013. This whole period was with same employer. I have been on work assignment in Europe since July 2012 till July 2013. What are my options for H1B extension or new H1B application? 1) Can my employer apply for recapture of the time I have been out US to extend my H1B? If yes, do they need to wait till I am back to USA or can they do it while I am here in Europe? 2) Am I eligible for new H1B application in 2014 quota since I would be completing 1 year out of USA in July 2013. If yes, can employer apply for new H1B in April 2013 or they have to wait till my 1 year out of USA is completed. Pls note there are some company policy issues related to GC processing, so the paper work for labor filing is still stuck, so I am looking for H1B options at this point.
JoeF Posted February 27, 2013 Report Posted February 27, 2013 You have to be outside the US before an employer can FILE a new H1 for you. If you left in July 2012, your employer can FILE a new H1 in July 2013.
