Vroom989 Posted February 27, 2013 Report Posted February 27, 2013 Hi, My employer is offering me $25/hr per diem and $20 as travelling with base as $25. So out of $70/hr they are offering $45 (25+20) as non taxable. Will this cause problem during H1??
SameerH1Bworker Posted February 27, 2013 Report Posted February 27, 2013 every city/state has limit on hourly per diem. check with your working city's per diem limit. It should not be above that limit.
JoeF Posted February 27, 2013 Report Posted February 27, 2013 Yes, it will cause problems. Per diem doesn't count as salary. And that employer seems to be abusing the per diem to avoid paying taxes. Stay away from that employer.

You need to have solid proof in order to get per-Diem, if not it will be illegal activity and will cause lot of problems in future.
wiweq Posted February 27, 2013 Report Posted February 27, 2013 You base salary (which is taxable) should be more than LCA salary. Is you LCA salary 50K?
t75 Posted February 28, 2013 Report Posted February 28, 2013 This saves your employer a lot. Consult an attorney BEFORE you sign on tho this to see if the job and. travel meets the requirements for per diem
