Can L1A be transferred to H1B on H1B Cap exempt with previous H1B expired Petition?

Currently I am on L1A working in US from past 1 year . I had been in US previously on H1B later which moved back to my country 10 years back. The H1B with my previous employer expired in 2005 which is 8 years back. Now is it possible to file an H1B on H1B cap exempt based on that expired H1B being on L1A now? Can you please clarify?
